Expenditure rules

The funds are held in an account in my name (Michael Cordover) but I disclaim any beneficial interest in these funds on the basis that they're used for the purposes described below. Interest is being earned on the funds to be used for those purposes.

For the avoidance of doubt, it is and always has been my intention for these funds to be held by me on trust for the objects described below.

The primary purpose of these funds is to secure the realease of the source code of EasyCount under freedom of information by prosecuting AAT case number 2014/3361.

Costs incurred in the course of prosecuting that case are reimbursable from the funds, including application fees, transcript fees, legal costs (though no fees for my time) and disbursements. Similarly other costs may be payable, including travel, accommodation and sundry costs for expert witnesses and for pro-bono legal support. If there is an access charge on ultimate release, this is to be paid from these funds as well.

These funds can be applied to any appeal or further action relating to this case; however not to the application lodged by the AEC to have me declared a vexatious applicant (as that application has been made in such a way as to specifically excude AAT application 2014/3361).

The secondary purpose of these funds is to be applied for the release of EasyCount source code and associated documentation by other means, including supporting other freedom of information requests. This could include paying access charges, appeal costs and disbursements at my discretion and if required.

The reserve purpose of these funds is to be paid to the OpenAustralia Foundation Limited, at my discretion on completion of the above purposes, or at the time I determine there is no further strong prospect of success.
